Welcome to Italian Choice Trading LLC. By accessing and using our website www.italian-choice.com, you agree to comply with the following Terms and Conditions. Please read them carefully before making a purchase.

1. GENERAL TERMS

These Terms and Conditions govern your use of our website and the purchase of our products.

We reserve the right to update or modify these Terms at any time without prior notice. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of the website after changes constitutes acceptance of the revised Terms.

By using our website, you confirm that you are at least 18 years old or have legal parental or guardian consent.

2. ORDERING & PAYMENTS

  • Orders are placed through our website or via authorized distributors.
  • All prices are listed in AED (United Arab Emirates Dirham).
    • Orders within the UAE include 5% VAT.
    • Orders shipped outside the UAE do not include VAT; however, the customer may be liable for VAT, customs duties, and clearance fees in the destination country.
  • Payments must be made through our secure payment gateways. We accept major credit and debit cards, online payment methods, and Buy Now Pay Later services (such as Tamara, where available).
  • When using Buy Now Pay Later services, the customer agrees to the terms and conditions of the respective provider. Italian Choice is not responsible for disputes arising from BNPL payment plans.
  • Orders are only processed once full payment is received (or BNPL approval is confirmed).
  • We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, suspected fraud, or stock unavailability. In such cases, a full refund will be issued.

3. SHIPPING & DELIVERY

  • We ship within the UAE and internationally to select countries.
  • Shipping costs and estimated delivery times are calculated at checkout.
  • For international shipments (including EU and GCC):
    • Customers are responsible for any import VAT, customs duties, and courier handling charges imposed by their local authorities.
    • These charges are not included in our prices or shipping fees.
  • Italian Choice Trading LLC is not responsible for delays due to customs, courier issues, or unforeseen circumstances.
  • Customers are responsible for providing accurate shipping details. We are not liable for lost or undelivered shipments due to incorrect addresses.
  • Risk of loss and title for products pass to you upon delivery to the carrier.

4. RETURNS & REFUNDS

  • Returns are accepted within 14 days of delivery, provided the product is unused and in original packaging with all accessories included.
  • Custom or personalized orders are non-refundable unless defective.
  • Refunds will be processed within 10 business days upon approval and issued to the original payment method.
  • Return shipping costs are the responsibility of the customer unless the item is defective or incorrect.
  • Please note: Any VAT, duties, or clearance fees paid to customs or couriers are non-refundable by Italian Choice. Customers must apply to their local authority for reimbursement if applicable.
  • We reserve the right to issue a partial refund if the returned item shows signs of wear, damage, or missing components.

5. WARRANTY POLICY

Our sunglasses come with a 24 month warranty against manufacturing defects.

Warranty does not cover damage caused by misuse, accidents, improper care, normal wear and tear, or unauthorized modifications.

Claims must be submitted with proof of purchase to salesUAE@italian-choice.com.

6. CUSTOMIZATION & CO-BRANDING TERMS

  • Custom branded sunglasses are subject to minimum order quantities, evaluated on a case by case basis.
  • The branding space is limited to a 45mm area adjacent to the IC logo on the temple.
  • Custom orders require upfront payment and are non-refundable once production begins.
  • Italian Choice retains all rights over its original designs, logos, and branding. Co-branding partnerships do not transfer ownership of any Italian Choice intellectual property.

7. INTELLECTUAL PROPERTY

All content on this website, including but not limited to text, images, graphics, logos, product designs, and software, is the property of Italian Choice Trading LLC and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, display, or use any content from this website without prior written consent from Italian Choice Trading LLC.

The Italian Choice name, logo, and all related marks are registered trademarks of Italian Choice Trading LLC.

8. PRIVACY & DATA PROTECTION

Your use of this website is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal data.

We comply with the General Data Protection Regulation (GDPR), the UAE Federal Decree Law No. 45 of 2021 on Personal Data Protection, and all other applicable data protection laws.

By using our website and making a purchase, you consent to the collection and use of your information as described in our Privacy Policy.

9. ELECTRONIC COMMUNICATIONS

By using our website, placing an order, or submitting any form, you consent to receive electronic communications from us, including order confirmations, shipping updates, and customer service responses.

Marketing communications (newsletters, promotions, product launches) are sent only with your explicit opt in consent and can be withdrawn at any time by clicking "unsubscribe" in any email or by contacting us at salesUAE@italian-choice.com.

10. LIMITATION OF LIABILITY

Italian Choice Trading LLC is not responsible for indirect, incidental, special, or consequential damages arising from the use of our products or website.

Our total liability for any claim arising from a purchase shall not exceed the amount paid for the product in question.

We do not guarantee uninterrupted or error free website operation.

Product images on the website are for illustrative purposes. While we strive for accuracy, slight variations in color or appearance may occur due to screen settings and manufacturing processes.

11. FORCE MAJEURE

Italian Choice Trading LLC shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, war, civil unrest, supply chain disruptions, transportation delays, or utility failures.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Italian Choice Trading LLC, its directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the website, violation of these Terms, or infringement of any third party rights.

13. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. GOVERNING LAW & JURISDICTION

These Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates.

Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.
